References to absolute human rights can be found in both scholarly writings and the case
law of international monitoring bodies, yet the concept itself is still not clearly defined,
hence remains inconsistently applied and marked by legal uncertainty and uneven
protection across legal systems. Therefore, this dissertation focuses on the concept
within the framework of international human rights law, in order to elucidate its meaning
and practical implications.
The research pursues three main objectives. First, it builds an innovative human rights
restrictions taxonomy, which is necessary for understanding and defining absolute,
unconditional rights.
Second, precise conceptual definition of absolute human rights is offered, distinguishing
them from related notions. The doctrinal positions and relevant case-law of international
monitoring bodies are critically assessed to develop a framework that is both theoretically
sound and operational in practice, followed by a list of rights that can qualify as absolute.
Third, the thesis situates absolute rights within the broader hierarchy of international
norms, while also exploring their relationship with neighbouring concepts, such as nonderogable
rights, jus cogens norms and erga omnes obligations, and their role in the
constitutionalisation of international law. Analysis of their interaction reveals whether and
when absolute human rights may be considered part of the peremptory core of international
law.
Methodologically, this research draws primary on conceptual analysis, supported by
complementary approaches, such as doctrinal interpretation and comparative analysis.
Historical and philosophical perspectives are also included, as they have the potential to
inform the conceptual framework. Finally, the account offered is based on a detailed
examination of the text of relevant international treaties, their travaux préparatoires, and
accompanying case-law.
The significance of this study may be in its potential to bring greater conceptual clarity
to a term that is widely used but rarely defined, thereby encouraging more consistent
judicial reasoning and stronger protection of core human rights, which should serve as a
safeguard against the erosion of human dignity in the most challenging circumstances.

Pojam apsolutnih ljudskih prava može se pronaći kako u akademskim radovima, tako i
praksi međunarodnih tela. Međutim, sadržaj ovog koncepta ostao je nedovoljno određen,
te on nedosledno primenjivan. Značenje ovog pojma se često podrazumeva umesto da bude
jasno artikulisano, što dovodi do pravne nesigurnosti i neujednačene zaštite u različitim
pravnim sistemima. Stoga je fokusu ove disertacije je pojašnjenje njegove sadržine i
praktičnih implikacija.
Tri su osnovna cilja ovog istraživanja. Pre svega, analiza predlaže novu sistematizaciju
ograničenja ljudskih prava, čije je definisanje i razumevanje neophodno za definisanje
apsolutnih prava.
Zatim, u radu je koncipirana precizna definicija pojma apsolutnih ljudskih prava, koja
bi trebalo da omogući njegovo jasno razlikovanje od srodnih koncepata. Kritičko
razmatranje doktrinarnih stanovišta i detaljno istraživanje relevantne prakse
međunarodnih sudova i kvazisudskih tela sprovedeni su u cilju izgradnje teorijski
utemeljenog okvira, koji je istovremeno primenljiv u praksi i praćen listom prava koja se, u
ovom momentu razvoja međunarodnog prava, mogu smatrati apsolutnim.
Naposletku, disertacija teži da pozicionira apsolutna prava u širi hijerarhijski okvir
međunarodnopravnih normi, te ispituje njihov odnos sa srodnim pojmovima, poput
nederogabilnih prava, jus cogens normi i erga omnes obaveza, kao i njihovu ulogu u
konstitucionalizaciji međunarodnopravnog poretka. Analiza međusobne povezanosti i
interkacije ovih koncepata otkriva i da li se i kada apsolutna ljudska prava mogu smatrati
peremptornim normama međunarodnog prava.
Metodologija istraživanja se oslanja na konceptualnu analizu, potpomognutu
komplementarnim metodama, poput doktrinarnog tumačenja i uporednopravne analize.
Istorijske i filozofske perspektive obogatile su ponuđenu konceptualizaciju, dok detaljno
istraživanje normi međunarodnih ugovora, travaux préparatoires i sudske prakse čine njenu
osnovu.
Značaj ovog istraživanja može se ogledati u njegovom nastojanju da unese pojmovnu
jasnoću u termin koji se često koristi, a retko definiše, i time pomogne doslednijem
sudijskom rasuđivanju, izradi uverljivijih obrazloženja presuda, a u krajnjoj liniji i boljoj
zaštit osnovnih ljudskih prava, koja bi trebalo da služe kao štit ljudskom dostojanstvu i u
najizazovnijim okolnostima.

Citation formats include permanent links that guarantee access to cited sources. For use are commonly structured metadata schemes : Dublin Core xml and ETUB-MS xml, local adaptation of international ETD-MS scheme intended for use in academic documents.
